Art. 89a Abs. 6 Ziff. 6 und Ziff. 19 ZGB; Art. 52 und 73 Abs. 1 lit. c BVG; Verantwortlichkeitsklage gegen die Organe eines patronalen Wohlfahrtsfonds; sachliche Zuständigkeit.
Aufgrund des Verweises von Art. 89a Abs. 6 Ziff. 6 ZGB ist die Verantwortlichkeitsbestimmung von Art. 52 BVG auf patronale Wohlfahrtsfonds analog anwendbar. Das mit berufsvorsorgerechtlichen Streitigkeiten betraute kantonale Gericht ist zuständig für eine Verantwortlichkeitsklage gestützt auf Art. 52 BVG gegen die Organe eines patronalen Wohlfahrtsfonds (Art. 73 Abs. 1 lit. c BVG i.V.m. Art. 89a Abs. 6 Ziff. 19 ZGB; E. 2-4).
